Third-Party Platforms

User Acknowledgment and Consent: By using Dual, users acknowledge that the app interfaces with platforms for connecting/uploading photos and videos, and collecting email and phone information, among potentially other services. Users must directly authenticate on these third-party web-apps. Dual expressly clarifies that it does not obtain, retain, or have any form of access to login credentials for any third-party services.
Compliance with Third-Party Terms: Users hereby agree and commit to comply fully with the terms and conditions, privacy policies, and any other legal agreements of any third-party platforms they connect to through Dual. This includes, but is not limited to, abstaining from using robots, crawlers, proxies, or any other automated or manual processes to access, retrieve, index, or mine data; and refraining from creating or using third-party applications that interact with the services or content of these platforms without their explicit written consent.
Express Permissions to Dual: Upon using Dual, users provide express permission for the app to analyze their swiping and texting preferences to create and run an action model on the connected third-party apps. This permission is granted with the understanding and agreement that such action models are designed to operate within the bounds of legality and the terms of service of the third-party platforms.
Indemnification and Release: Users agree to indemnify, defend, and hold harmless Dual, Keygen Labs, Inc., its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with their access to or use of Dual and third-party platforms, or their violation of these Terms. Users further agree that Dual assumes no responsibility for any actions taken by third-party platforms, including but not limited to bans or similar punitive measures, as a result of using Dual's action models.
Liability Limitation: Dual disclaims all liability arising from the users' failure to adhere to the terms and conditions of third-party platforms. Users acknowledge that their use of Dual in a manner not authorized by the terms of service of connected third-party platforms may result in their access being revoked by those platforms, and that Dual shall not be liable for any loss or damage suffered as a result of such revocation.

We shall not be held responsible for any content that appears on your App. You agree to protect and defend us against all claims that are rising on your App.

Reservation of Rights

We reserve the right to request that you remove all links or any particular link to our App. You agree to immediately remove all links to our app upon request.

Disclaimer of Warranties and Limitation of Liability

The app and its content are provided "as is" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

These terms and conditions will be governed by and interpreted in accordance with the laws of New York, and you submit to the non-exclusive jurisdiction of the state and federal courts located in New York for the resolution of any disputes.
